Kane County Circuit Court Clerk

Theresa Barreiro serves as the Kane County Circuit Court Clerk. The office is at 540 S. Randall Rd., St. Charles, IL 60174. Phone: 630/232-3413, fax: 630/208-2172. The clerk's website at countyofkane.org/circuitclerk has details on office hours, services, and the types of records managed. The 16th Judicial Circuit covers Kane County only, so the St. Charles office is the single point of contact for all Kane County criminal court filings.

The clerk's office stores felony and misdemeanor criminal case files, traffic violation records, court orders, and judgment documents. For each criminal case, the public file typically includes the charging instrument, case history, court dates, orders entered by the judge, and the final disposition. Staff can help you locate a specific file if you have a name or case number.

Illinois law makes these records available to the public. Under 705 ILCS 105, the Clerks of Courts Act, records must be open for inspection at no charge. Copies carry a fee; looking does not. You don't need to state your purpose or prove any relationship to the case to view a public court record.

Online Case Search for Kane County

Kane County's case information portal is at countyofkane.org/circuitclerk/Pages/Case-Information.aspx. From there you can look up cases by name or case number and see charge details, hearing dates, and case status. The portal covers both open and recently closed cases. For older records, you may need to request them directly from the clerk's office.

Kane County is also part of the Judici.com network, covering 82 Illinois counties. Judici gives you an alternative search interface and is especially useful if you're not sure whether a case was filed in Kane County or a neighboring jurisdiction like DuPage or McHenry. Basic name searches are free and don't require an account.

Cases that were appealed can be found through re:SearchIL, the free statewide appellate records portal that opened to the public on May 1, 2025. Trial-level records stay at the local clerk level; re:SearchIL covers cases in the Second Appellate District, which handles Kane County appeals.

In-Person and Mail Record Requests

To view records in person, visit 540 S. Randall Rd. in St. Charles during normal courthouse hours. Bring the subject's full name and date of birth; a case number helps speed up the search. Staff will locate the case in the system and let you review it. If you want copies, pay the applicable per-page fee at the clerk's counter.

For mail requests, write to the same St. Charles address. Include the subject's name, approximate case date or year, and any case number you have. The clerk will respond with a cost estimate before mailing copies. Fax requests go to 630/208-2172. Response time varies by volume; plan for at least one to two weeks.

Statewide Conviction Records

Kane County court records only cover cases filed in Kane County. For a complete Illinois criminal history, you need the Illinois State Police Bureau of Identification. ISP BOI compiles conviction data from all 102 counties and produces certified background check reports used for employment, housing, and licensing decisions.

The Uniform Conviction Information Act (20 ILCS 2635) sets the legal framework for this statewide system. Conviction records are available to the public through ISP. Arrest records that did not result in conviction are treated more carefully and may not appear in third-party background checks. Order a conviction check online at isp.illinois.gov/BureauOfIdentification/BackgroundChecks.

Individuals who want to see or dispute their own criminal history can use the CHIRP system at no charge. ISP also offers a free Access and Review process for individuals who want a printed copy of their own record. For fingerprint-based background checks, contact ISP BOI at 260 N. Chicago St., Joliet, IL 60432, phone 815/740-5160.

Electronic Filing in the 16th Circuit

Kane County uses eFileIL, the mandatory statewide e-filing system, for most case types. Attorneys are required to e-file. Self-represented parties in criminal cases should check with the clerk's office about specific requirements. Electronic filing is for submissions only; public records lookup uses the county's case search portal or Judici, not eFileIL.

Note: If you are a party to a case and want to see your own case file electronically, ask the clerk's office about remote access options for parties. The rules differ from general public access.

What Is Public and What Is Not

Most Kane County criminal court records are open to anyone who asks. The presumption of public access is built into Illinois law through the Court Record and Document Accessibility Act (705 ILCS 86) and the Clerks of Courts Act. Charging documents, court orders, plea records, and sentencing documents are all public.

Some records are off-limits. Juvenile delinquency records are sealed. Adoption files are closed. If a court has entered a sealing or expungement order, that record will not appear in any public search. Social Security numbers and financial identifiers are redacted from any copy provided to the public. The Illinois FOIA law (5 ILCS 140) does not apply to courts, so you cannot use a FOIA request on the Kane County clerk. Work through the clerk's standard public access process instead.
